LOCAL 1930
MEMORANDUM OF AGREEMENT


The Collective Bargaining Agreement by and between The New York Public Library and Local 1930, District Council 37, AFSCME, AFL-CIO in effect on June 30, 2002 as modified below, is hereby extended through June 30, 2005.

1. Add to Article VI (Pay Differentials) – Section 2
For employees hired on or after July 1, 2004, the night differential will be in effect from 8:00pm to 8:00am for the first three years of employment.

2. Modify Article X (Scheduling) – New Section 8
The Library will grant a “bonus” day on December 24, 2004.

3. Add to Article X (Scheduling) Section 9 (Floating Holiday)
Employees hired on or after July 1, 2004 will not be eligible for one floating holiday.

4. Add to Article XI (Leave Regulations), Section 1 (Annual Leave)
Employees hired on or after July 1, 2004 will earn a new annual leave schedule as recorded below:

5. Modify and add to Article XI (Leave Regulations), Section 2 (Sick Leave)
Employees hired on or after July1, 2004 will accrue sick leave at a rate of 10 days per year for the first five years of employment.

Modify Section 2(a) to read three (3) instead of two (2) sick days per calendar year for which a staff member is otherwise eligible may be taken for the care of a child or dependent parent.

6. Modify Article XVII (Extreme Temperature Procedures) Section 4 as follows:
1. All references to “68 degrees” shall be changed to “67 degrees”.
2. In the event the temperature drops below 67 degrees, staff shall not be sent home unless it is dangerous to continue working in the affected building or area. Staff members who continue working in such circumstances shall receive compensatory time.

7. Add to Article XIX (Classification), Section 2
A staff member who requests reclassification from his/her supervisor but does not receive a response within thirty days may submit the request to the Human Resources Department on a form provided for that purpose.

8. Modify Article XXX (Economic Terms) – Section 1
(a)(i) $1000 pensionable lump sum cash payment payable to full time per annum employees on the basis of guidelines issued by The City of New York, Office of Labor Relations.
.
(ii) Part time per annum employees shall receive the lump sum provided in paragraph (a)(i) of this subsection on the basis of guidelines issued by The City of New York, Office of Labor Relations.

(b)(i) Effective July 1, 2003, employees shall receive a general increase of 3 percent.
(ii) Effective July 1, 2004 employees shall receive an additional general increase of 2 percent.
(iii) Part-time per annum employees shall receive the increases provided in paragraphs (b)(i) and (ii) of this subsection the basis of computations heretofore utilized by the parties for all such employees.

(c) The general increases provide for in (b) above shall be calculated as follows:
(i) The general increase in (b)(i) shall be based upon the base rates (including salary or incremental salary schedules) of the applicable titles in effect on June 30, 2003.
(ii) The general increase in ((b)(ii) shall be based upon the base rates (including salary or incremental salary schedules) of the applicable titles in effect on June 30, 2004.

(d)(i) The general increase provided for in the Section shall be applied to the base rates, incremental salary levels and the minimum and maximum rates (including level) if any, fixed for the applicable titles, and to “additions to gross”. “Additions to gross” shall be defined to include uniform maintenance allowance, assignment differentials, service increments, longevity increments, longevity differentials, advancement increases, assignment (level) increases, night shift differentials and other applicable “additions to gross” established during the term of this agreement.

(e) In the event the Joint Committee on Productivity Initiatives (referred to in Section 5 of the 2002 DC 37 Memorandum of Economic Agreement) identifies efficiencies which result in additional monies being made available to the Library, the parties will meet to discuss whether the Library can identify and achieve similar efficiencies substantial enough to justify additional salary increases.

(f) Any financial obligations, including but not limited to wages, longevity increments, equity payments, annuity and additional compensation fund and fringe benefits incurred by The Library under this Agreement for staff members on New York City reimbursable lines is expressly contingent
upon reimbursement by New York City for those financial obligations; and, in the absence of reimbursement said obligations are voided to the extent of such absence of reimbursement.

9. Add to Article XXX(Economic Terms), Section 2 – (New Hires)
The hiring rate for employees hired on or after July 1,2004 will be 15% lower than the incumbent rate. After two years of service, employees will earn the incumbent rate.

10. All references to the City-wide Contract shall be updated.

11. Modify nomenclature to reflect organizational changes within The Library since the last contract.

12. The contract will be updated to include all new titles, which appropriately belong in the bargaining unit.

This Memorandum of Agreement is subject to ratification by the members of Local 1930 and approval by the Trustees of the Library.
